Contract Framework

How your Neal Roofing contract is structured.

Neal Roofing undertakes roofing, leadwork, heritage roofing, repair and maintenance projects for homeowners, property professionals, businesses and other organisations.

This page explains the contractual framework applying when you instruct us and how your quotation, specification, project documentation and applicable Terms & Conditions work together.

Your project-specific quotation remains central to the agreement. It identifies what we have agreed to undertake, how the work is priced and any particular assumptions, exclusions or project requirements.

Your Contract with Neal Roofing

When you accept a quotation from Neal Roofing, your contract is with Geoff Neal (Roofing) Limited trading as Neal Roofing.

Your contract will normally comprise:

  • the accepted quotation;
  • the project-specific scope, specification, schedules and drawings expressly incorporated into that quotation;
  • any subsequent written variations or amendments; and
  • the applicable Neal Roofing Terms & Conditions.

These documents should be read together.

The quotation identifies the work we have agreed to undertake, the contract price or basis of pricing, project-specific assumptions and exclusions, and any particular payment or programme requirements.

Which Terms Apply?

Different contractual terms apply according to the nature and extent of the work being undertaken.

Substantial Works

Roofing & Replacement Works

For complete or partial roof replacement, pitched and flat roofing, slate and tile roofing, leadwork, heritage work and other substantial roofing projects.

Limited Scope

Repairs & Maintenance

For isolated roofing repairs, maintenance, investigation and other limited-scope roofing interventions.

Repair Terms

Repair work is fundamentally different from complete roof replacement. A repair quotation relates only to the defects, locations and work expressly identified within the quotation.

Unless expressly stated otherwise, a repair does not constitute a complete investigation, renewal or guarantee of the roof, drainage system or associated building fabric.

The applicable Terms & Conditions will normally also be identified or linked within your quotation.

Your Quotation & Scope of Works

Your quotation is an important part of the contract.

Please read the description of the Works, specification, assumptions, exclusions, payment provisions and other project-specific information carefully before accepting it.

Unless expressly included within the quotation, Neal Roofing should not be assumed to have allowed for work that becomes apparent only after existing roof coverings, finishes or building fabric have been opened up or removed.

Roofing work can expose previously concealed conditions including:

  • defective roof timbers and structural components;
  • defective masonry or substrates;
  • historic structural movement;
  • inadequate or defective insulation;
  • previously concealed alterations;
  • defective historic construction;
  • concealed services; and
  • hazardous or suspected hazardous materials.

Where additional work becomes reasonably necessary, we will normally explain the issue and, where practicable, provide the cost or basis of charging before proceeding.

Such work will be treated as a Variation to the original Works.

Consumer & Business Customers

Neal Roofing works for homeowners, landlords, businesses, developers, contractors, property professionals and other organisations.

Some legal rights and contractual procedures differ depending upon whether you are contracting with us as a consumer or in the course of a business.

Nothing within our quotation or Terms & Conditions is intended to exclude or restrict any statutory right or liability which cannot lawfully be excluded or restricted.

Where consumer legislation applies, your statutory rights remain unaffected.

Accepting a Quotation

A quotation may be accepted using the acceptance method provided by Neal Roofing, including through our electronic quotation and project management systems.

By accepting a quotation, you confirm that you have had the opportunity to review:

  • the quotation;
  • the scope and specification of the Works;
  • the applicable Terms & Conditions;
  • any expressly incorporated schedules or drawings; and
  • any project-specific assumptions or exclusions.

Your acceptance creates a contract subject to any applicable statutory cancellation rights.

Consumer Cancellation Rights

Where you are contracting as a consumer, statutory cancellation rights may apply, particularly where a contract is concluded online, by telephone or away from our business premises.

Where applicable, information concerning your cancellation rights will be provided as part of the quotation or acceptance process.

If you expressly ask us to commence services during a statutory cancellation period, you may be required to pay for work properly undertaken before a subsequent cancellation.

Where urgent repair or maintenance work is requested, different statutory provisions may apply depending upon the circumstances.

Building Regulations & Statutory Approvals

Depending upon the Works, a project may require Building Regulations approval, competent-person certification, planning permission, listed building consent, conservation approval, Party Wall procedures, structural engineering or another statutory or third-party approval.

Our responsibility for obtaining or providing any such approval or certification is limited to that expressly identified within our quotation.

Unless expressly stated otherwise, responsibility for permissions and approvals relating to the property remains with the Customer.

Nothing within our contract prevents Neal Roofing from complying with its own statutory obligations.

Changes & Additional Work

Roofing projects frequently develop as existing construction is exposed.

Changes may also arise because of Customer instructions, statutory requirements, design development, material availability or conditions that could not reasonably have been established before work commenced.

Where the scope of the Works changes, the additional or omitted work will be dealt with as a Variation in accordance with the applicable Terms & Conditions.

Where circumstances require immediate action to protect the property, maintain safety or prevent deterioration, we will take reasonable steps to contact the Customer before undertaking material additional work wherever practicable.

Natural, Traditional & Reclaimed Materials

Many Neal Roofing projects use natural, handmade, traditional or reclaimed materials.

These can include natural slate, clay tiles, reclaimed roofing materials, timber, stone and lead.

Such materials naturally exhibit variations in dimensions, thickness, colour, texture, surface appearance, weathering and other characteristics.

Reasonable variation of this nature is inherent in these materials and does not, by itself, constitute defective material or workmanship.

Where reclaimed materials are specified, their aged and weathered characteristics form part of the intended appearance of the finished work.

Workmanship, Guarantees & Certification

Neal Roofing will carry out the Works using reasonable care and skill and in accordance with the contractual specification.

Where a Neal Roofing workmanship guarantee applies, its duration and extent will be stated within the quotation, completion documentation or applicable guarantee terms.

Manufacturer warranties and third-party guarantees are subject to their respective terms and conditions.

Where Building Regulations or competent-person certification forms part of our agreed scope, the relevant documentation will normally be provided following completion of the applicable Works and settlement of the account.

Roofing Guarantees

Repairs & maintenance

Different provisions apply to isolated repairs and maintenance works. A repair should not be interpreted as a guarantee of parts of the roof or building outside the agreed scope.

Defects & Concerns

If you believe there is a problem with work undertaken by Neal Roofing, please contact us promptly and provide reasonable details of the issue.

Except in an emergency, Neal Roofing should be given a reasonable opportunity to inspect the alleged defect and, where we are responsible for it, an appropriate opportunity to rectify it before another contractor alters or removes our work.

This helps establish the cause of the problem and allows matters to be resolved efficiently.

Project Records & Communications

Neal Roofing may maintain digital project records relating to the Works.

These may include:

  • quotations and specifications;
  • programmes and schedules;
  • site records;
  • risk and method information;
  • photographs and videos;
  • correspondence;
  • variations;
  • invoices;
  • certification; and
  • completion records.

Electronic communications and records may form part of the contractual and project record.

Where a customer or project portal is provided, it may be used to make relevant project information available during and following the Works.

Complaints & Dispute Resolution

We aim to resolve concerns directly and proportionately.

Customers should initially raise any complaint with Neal Roofing so that we have a reasonable opportunity to investigate and respond.

Where a matter cannot be resolved directly, the applicable Terms & Conditions set out the contractual dispute-resolution provisions.

Nothing in our complaints procedure affects any statutory rights or dispute-resolution rights available to either party.

Privacy

Personal information is processed in accordance with our Privacy Policy.

Project records may contain customer, property and project information necessary for administering the contract, undertaking the Works, maintaining appropriate records and complying with our legal and regulatory obligations.

Keeping Your Contract Documents

Customers should retain their accepted quotation, applicable Terms & Conditions, written variations, invoices, certification, guarantees and completion documentation as part of the permanent record for the property.

These records may be relevant to future maintenance, guarantee enquiries, property transactions and subsequent roofing work.
